ELITE BASKETBALL ASSOCIATION LLC TERMS OF SERVICE - Welcome to the Elite Basketball Association LLC (“EBA”). The EBA is a subsidiary of MH ENTERPRISES. These Terms of Service (“Terms”) govern your access to and use of the EBA website, services, and products (collectively, the “Services”). IF YOU DO NOT AGREE WITH ALL OF OUR TERMS, DO NOT USE OUR SERVICES. By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services. 1. Membership In order to access and use the Services, you must become a member of the EBA. To become a member, you must be at least 18 years of age and agree to these Terms. Private 1 on 1 training memberships are minimum one year commitment, small group training is minimum three month commitment, non-negotiable. 2. Fees You agree to pay all applicable fees associated with your membership or program in the EBA. All fees NON-refundable. ALL FEES ONCE PAID TO US IS CONSIDERED CREDIT THAT CAN BE UNIVERSALLY USED ON ANY PROGRAM WE OFFER. Even if ‘we’ the EBA cancel or postpone a program for any reason. (statements must be acknowledged at checkout before payment to avoid any conflicts or confusion). Any program may be canceled, postponed or rescheduled due to any number of factors, including but not limited to: weather, low registration numbers or turnout, personal conflicts of any kind, facility scheduling, etc. If you have questions about the NO-REFUND policy, please refer to the Massachusetts Consumer Laws.

Your membership IS NOT A PACKAGE. We do not sell lesson packages.  If you cancel or miss a lesson, class etc.  it is NOT required by the EBA to make it up. Monthly Membership means you get ‘x’ amount of lessons, classes, etc. to attend per month, and you pay to be able to use our services maximum ‘x’ amount of times depending on membership. If you do not attend every single lesson, you are not entitled to the ones you cancel or miss. If the EBA cancels a lesson or class as part of your membership, we are obligated to make up the canceled lesson, class, event, etc. “Makeups” can include but aren’t limited to camps, clinics, weekly classes or 1 on 1 lessons. We the EBA hold the right to use any service we offer as a makeup for ANY canceled or rescheduled program.

Membership Payments: You have the ability to prepay for your membership up front to get the savings. If you can not pay up front for the savings, the other payment plan option we offer is a 50% deposit on the training fee (varies between programs and memberships). After that,  clients have the ability to select AfterPay at checkout to pay in 4 installments. This is the only payment plan option we offer. No monthly payments. Non negotiable.

Scheduling: We schedule for your convenience. As the Client you are expected to schedule your sessions each week with the EBA or your coach for 1 on 1 sessions. It is not the EBA’s responsibility to contact you for scheduling. Group programs have set days and times every week. 

Cancellations: All clients must be ON TIME! Arriving 15 or more minutes late without notice results in termination of session and there will be no make up session. Being late by 15+ minutes 3 times without prior notification will result in termination as a client. 

ALL CLIENTS should be subscribed to our email list to receive notifications about cancellations, make ups and general announcements. If you are not subscribed we highly recommend it to avoid any conflict. We are not responsible for you, the client, showing up to a canceled session if we provided prior notice via email list that you chose not to subscribe to. 

If a client cancels the day of the private lesson, it is marked as completed and this lesson will not be made up, due to late cancellation policy. If a client cancels the day of a group session it will only be made up once a month. Clients only get 1 makeup per month to avoid any abuse of our programs makeup policies.

If a client wants to cancel their commitment with the Elite Basketball Association LLC, they MUST pay $450 as the cancellation fee in order to cancel.  NON-NEGOTIABLE. If a client paid up front for the year and wants to cancel, they are not entitled to any refund of any kind. They will have universal credit to be used on any program we offer within 90 days of cancellation request.  If the client does not pay the fee to cancel, membership is not officially canceled, & legal action will be taken as needed. Non-negotiable.

4. Privacy We respect your privacy and are committed to protecting it. Please refer to our Privacy Policy for information about how we collect, use, and disclose information about you. 5. Termination: We may terminate or suspend your access to the Services at any time, with or without cause. If we terminate or suspend your access to the Services, you will not be entitled to a refund of any fees paid. 6. Disclaimer of Warranties THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. 7. Limitation of Liability TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES). 8. Governing Law These Terms shall be governed by and construed in accordance with the laws of the State of Massachusetts, without regard to its conflict of law provisions. 9. Changes to These Terms We may revise these Terms from time to time. The most current version of the Terms will govern our relationship with you. We will notify you of any changes to these Terms by posting the revised Terms on our website. The EBA reserves the right to change our terms of service without warning. 10.
